In the widely reported case of Fisken v Carl, the High Court in London has found that the defendant seller of one of the world’s most expensive cars, a $44 million Ferrari 250 GTO Series 1 coupé, was acting in breach of contract in failing to deliver the GTO’s original gearbox to the claimant buyers.
The case concerned a contract for the sale of the GTO. It was known at the time of the contract that the GTO was missing its original gearbox. When it transpired that the gearbox had been found, the claimant buyers sought its delivery from the defendant seller.
