The Australian Tax Office (ATO) has obtained freezing orders against the assets of foreign property developers in recent cases, that reached Australia’s Federal Court. In these, the ATO had audited the taxpayers ordered them to pay over AUD 100 million in tax for their profits from property developments. Then the ATO immediately applied for freezing orders without notifying the affected developers, to make sure the tax was collected before the profits were transferred overseas.
