Court of Appeal ruling could make alternative dispute resolution mandatory

A Court of Appeal ruling has found that judges have the power to order parties in a case to engage in alternative dispute resolution (ADR).

The case, Churchill v Merthyr Tydfil County Borough Council, related to Japanese Knotweed encroaching onto the claimant's property from land owned by the local council.

When Mr Churchill made a claim, the council applied for a stay on proceedings arguing that its complaints procedure had not been used.
